In 2018, we acted for a member of an IG club in general average matter. The vessel declared general average, but after arrival at Chittagong the receiver refused to give any average bond or guarantee and arrested the vessel. We successfully contested the matter in the court and for the first time in Bangladesh the court directed the receivers to provide the ship-owners with the general average bond and guarantee prior to taking delivery of cargo.
The name of the firm changed to MCLaw Services Ltd. in this year.
In this suit our client, the charterers of the vessel were wrongfully made the party in the suit. We acted on behalf of the charterers. We applied before the court and successfully got the name of the charterers struck out from the suit.
In this case a Bangladeshi seafarer was employed on a foreign flag vessel. The owners made the Seafarer join the vessel in a West African port. He was not given required vaccination. The crew complained of fever few days after release of the vessel without security. The master of the vessel treated him with analgesics and anti-diarrhoea medical and did not take his illness seriously. The crew member and his family requested owners to sign him off but the owners refused to sign him off to an intermediate port. He collapsed when the vessel reached the port of discharge and had to be air lifted to the hospital ashore by helicopter. Soon after he was taken to the hospital the doctors declared him dead and it was found that his all internal organs were damaged by cerebral malaria. The owners refused to pay compensation to the widow and the minor child of the seafarer. We acted for the seafarer and helped the widow and the child receive the compensation that was lawfully due.
In another case involving Bangladesh Shipping Corporation, the vessel of Bangladesh Shipping Corporation was arrested for an alleged short landing claim by the charterer. We contested on behalf of the Bangladesh Shipping Corporation and the vessel was released without any security as the court held that Bangladesh Shipping Corporation’s vessel need not to be arrested within Bangladesh’s jurisdiction as any claim against Bangladesh Shipping Corporation is adequately secured.
In this case we acted for a Bangladeshi ship owner whose vessel had been involved a collision with a Greek vessel. The collision occurred while the Greek vessel was overtaking the Bangladeshi vessel weighing up her anchor. Following the collision the Greek vessel collided with the jetty and damaged the gantry crane. We contested the matter on behalf of the Bangladeshi ship-owner. There was lengthy litigation but we managed to get a very favourable settlement for the owner and the Bangladeshi ship-owner did not suffer any delay or disruption nor had to pay any cost for the damage to the jetty caused by the collision with the Greek vessel.
